Anti‑SLAPP Act Enters into Force in Poland. Commentary by Attorney Maciej Ślusarek in Dziennik Gazeta Prawna

As of 8 July, Poland’s new anti‑SLAPP Act is in force, introducing specific protective measures for participants in public debate – including journalists, activists and civil society organisations – against the abusive use of lawsuits aimed at creating a chilling effect on public discourse. The objective of the new provisions is to limit the use of personality rights litigation as a tool of pressure, while preserving the right to protection of one’s reputation.
The significance of the Act and the instruments it provides to the courts (including, in particular, security for costs and the possibility to award full reimbursement of the actual costs of legal representation) are discussed in an interview for Dziennik Gazeta Prawna by Maciej Ślusarek, managing partner at SKP and chair of the SLAPP Working Group of the Civil Law Codification Commission.
