Judgment of the District Court in Warsaw in the case of Jan Radziwon v. the State Treasury
15. 01. 2026
We are proud to announce that on 12 January 2026, the District Court in Warsaw, Third Civil Division, issued a judgment in the case of Mr Jan Radziwon v. the State Treasury, finding that the personal rights of the then 17-year-old activist were violated during his detention. SKP represented Mr Jan Radziwon pro bono.
In November 2020, Jan Radziwon participated in a demonstration in front of the District Court in Warsaw on Solidarności Avenue, which was held as part of the Women’s Strike and was an expression of solidarity with an activist who had been detained earlier. The court ruled that during the police intervention, which resulted in the detention of Mr Jan Radziwon, his freedom and dignity had been violated. In its oral reasoning, the court emphasised that the actions of the officers were not proportionate to the course of the protest. The judgment is not final.
The ruling of the District Court in Warsaw is of fundamental importance for the protection of civil rights in Poland. We are pleased to contribute to efforts aimed at building a society in which constitutional freedoms and human rights are respected.
The SKP team involved in the case comprised: trainee advocate Aleksandra Szwajkowska, advocate Hanna Marcinkiewicz-Grzesiak, advocate Maria Dżaluk, and advocate Maciej Ślusarek.
