Dispute concerning the right to use the name of a band
We represented one of the most famous Polish bands De Mono in a dispute over the right to use the band’s name. After many years of court proceedings, the Court of Appeal legally determined that the exclusive rights to the band’s name belong to our clients, while former band member Mr Marek Kościkiewicz can only use the name in a historical context. The Court of Appeal stated that the name of a music band is a special kind of personal property that can only be exercised by a band. After Mr Marek Kościkiewicz left the band, this personal good, which is De Mono, was continuously built up by them, filled with further content – in which Mr Marek Kościkiewicz did not participate. The name belongs exclusively to this band with Mr Andrzej Krzywy and Mr Piotr Kubiaczy
Support for hip-hop artists
SKP helps to create and protect hip-hop creativity. This scope of the music industry also presents legal challenges – the use of samples, the work of music producers, digital distribution, the protection of labels and music brands, and the handling of major marketing and advertising contracts.
Support for music bands
Since 2000, we have provided services to around 50 bands and artists. The cooperation consisted of support during the release of albums, negotiation, and conclusion of contracts. In addition, we have represented artists in several lawsuits, such as copyright infringement, band name rights, or trademark infringement.
Precedent sampling trial
We represented the well-known Polish singer Stan Borys in disputes concerning the unlawful use of a fragment of his song in the chorus of a prominent hip-hop hit. After a dispute that lasted several years, the parties reached a settlement and confirmed that the use of the samples requires the consent of the author and performer whose work was used.
Legal support for music festivals
Our lawyers are experienced in providing legal services to music festivals. We advise on all stages of such undertakings – from protecting the concept and branding of the event through agreements with sponsors and local authorities regarding the name and venue of the event to relations with ticket sellers. We have supported organisers in obtaining approvals and permits necessary to plan mass events and in negotiations with Polish and foreign stars performing at events.
Comprehensive services for the release of the album
For leading Polish artists, we prepared and negotiated agreements related to the release of the album – with record labels and distributors regarding the promotion of the album and with the artists and crew participating in the recording.
Music Masterclass scholarship programme
The Norblin Factory Foundation has prepared a scholarship programme for the most talented musicians. Out of 413 applications, the jury selected six scholarship recipients and an individually tailored artistic mentorship programme for two participants. The Music Masterclass programme is intended for expressive, talented musicians who want to reach a wider audience with their work and need to draw knowledge and inspiration from recognised authorities on their artistic path. One of the mentors in the programme was Maciej Ślusarek, who conducted classes on copyright law for the scholarship holders.
